  1. Read statement of facts
  2. Read what person is accused of and definition of that fact
  3. List possible defenses against the charge
  4. Lay out the ultimate question to be proved and the penultimate questions

    • Each question has a evidential fact counterpart - factum probans
    • You know that you have found all the lower level questions if all of them answered positively would undoubtably prove the higher level question
  5. Consider the evidence in relation to the probanda and formulate questions

  6. Connect the ultimate fact to the penultimate facts
  7. Link evidence to the penultimate facts directly or through deduction or induction
  8. Defense possibilities go to the side and target different parts
